The bill specifies that the educational activities at the location of a branch of the organization, with the exception of organizations, the licensing of which relates to the powers of federal authorities in the field of education, is licensed by the state authority of the subject of the Russian Federation, carrying out the transferred powers in the field of education, on the territory of which the branch is located, as well as the fact that in the case of the intent of the licensee to carry out educational activities at the location of the branch of the organization, the licensee is not obliged to carry out the licensing of educational activities.

This legislative initiative, in our opinion, not only fully complies with the constitutional principles of the administrative-territorial structure of the Russian Federation established by federal legislation[11], according to which the executive bodies of state power of the subjects of the Russian Federation may exercise powers solely within the territory of their subjects, but also ensures organizational and financial efficiency of the implementation of the transferred powers of the Russian Federation in the field of education.

The implementation of administrative and legal functions (including the provision of public services and the implementation of state control (supervision) in the field of education) by the executive authorities of the constituent entities of the Russian Federation outside the boundaries of their subjects, as practice has shown, is economically inexpedient, entails large financial costs for the implementation of these functions, including the significant territorial distance between many constituent entities of the Russian Federation.

The draft law introduced to the State Duma for consideration, if adopted, will radically change the approaches to the implementation of other powers transferred to the executive authorities of the subjects of the Russian Federation in the field of education: state accreditation of educational activities, state quality control and supervision in this area.

Accordingly, the settlement of the existing legal uncertainty in the part of licensing of educational activity is only the first step of the legislative division of competence between the executive authorities of the subjects of the Russian Federation, which carry out the transferred powers in the sphere of education. The next task will be the differentiation of the competence at realization in the sphere of education of other transferred powers that in its turn can demand additional regulatory and legal regulation of mechanisms of the organization of activity of executive authorities of the subjects of the Russian Federation in new conditions
